A Partial Release of Lien allows the individual unit owner of a condominium unit or unit in a homeowner's association (HOA) to obtain a release of lien for their specific unit. This applies to liens recorded by the City of Sunny Isles Beach against the Association's common elements for code violations committed by the Association.
To obtain a Partial Release of Lien, the unit owner must make a pro rata payment of the lien amount (based on the unit's percentage of membership of the Association) plus administrative fees for preparing the release and research fees.
Offer amounts are only provided for existing liens resulting from violations issued by the City of Sunny Isles Beach Code Compliance Department. The letter will not inclde violations or citations that have not resulted in a lien. If no lien exist, a payoff letter wil not be provided, and there will be no refund or credit for the processing service fee.
Processing Service Fee: A non-refundable service fee of $75 per address must be paid in advance.
Turnaround Time: It can take up to 14 business days to process the request and provide findings. Time may be extended based on complexity. Request cannot be expedited and is completed based on order of received once requirements are met.
Partial Release of Lien Offer: We will tell you how much you have to pay (if anything) to be released from the lien. The Partial Release of Lien Offer is valid for 15 business days from the date that the offer is emailed to the requestor. When the offer expires, you will have to request a reassessment of the Partial Release of Lien. An additional service fee of $75 applies. It can take up to 14 business days to process and update the reassessment.
